Dear Prof. Eliassen,

Joint legal scrutiny of ECOMET rules and practices, cont.

I am approaching you on the above issue due to the fact that Antonio Verga somewhat unexpectedly resigned on 28 December 2005 as PRIMET Secretary General, and as a new management team for PRIMET will only be nominated at the Annual General Meeting (AGM) in Milano on 25-26 February 2006.

With reference to our past communications on this matter we should now discuss how to proceed in practice with the agreed legal scrutiny. I would suggest a solution along the following lines:

• The ECOMET and PRIMET position documents for the study are mailed (post stamped) in parallel to the other party on Wednesday 15 March 2006;
• the above two documents are used as the foundation for a coordinated selection by joint agreement of the legal company to be used for the legal scrutiny;
• following the choice of legal company, both parties are given two weeks (exact dates to be agreed later) in order to further elaborate their position document before the initiation of the full effort by the selected company.

Obviously there are at least two main issues to address:

1. the agreed selection of a specific company, which may require a tendering procedure;
2. the overall project cost, which as agreed should be covered by ECOMET.
