PRIMET has submitted a statement of the case for significant changes to the provisions of the EC PSI Directive 2003/98/EC which is currently under review by the Directorate of Libraries and Information.
The principal recommendations made by PRIMET to the Directorate in relation to the review of the PSI Directive are:
a) All PSI should be available for re-use except on the grounds that its release would prejudice national security
b) All PSI should be disseminated for re-use in a manner that is timely and effective having regard to the purpose for which it is intended.
c) If charges are levied for the re-use of PSI, they should normally be restricted to the costs of re-formatting (if required by the user) and supply . Public sector bodies should be required to publish the calculation basis they apply for such charges and independent audit appeal bodies should be established in each member state in order to ensure that costs are assessed in an equitable manner as proposed in the EC Communication
d) Public Task, which affects many of the provisions of the Directive should, for the purposes of the Directive, be clearly defined in such a way as to avoid unfair competition between the public and the private sectors.
